Privacy Policy

How AposHealth collects, uses, protects, and shares information from visitors and AposCare service users.

Apos US Management Inc. d/b/a AposHealth (“AposHealth” or “we”) provides this Privacy Policy to inform you of our policies and procedures regarding the collection, use, and disclosure of personal information we receive from users of our website at https://www.aposhealth.com/ (the “Site”) and our proprietary set of services made available through the same, including New York City Physical Therapy, PLLC d/b/a AposCare teletherapy and remote care services (“AposCare Services”).

This Privacy Policy applies to your access to and use of the Site and the AposCare Services. By choosing to use them, you consent to the collection, transfer, processing, storage, disclosure, and other uses of your information described in this Privacy Policy.

As used in this Policy, the terms “using” and “processing” information include using cookies on a computer, subjecting information to statistical or other analysis, and using or handling information in any way, including collecting, storing, evaluating, modifying, deleting, using, combining, disclosing, and transferring information within our organization or among affiliates within the United States or internationally.

Please read this Privacy Policy carefully before you use the Site and/or AposCare Services.

1. Changes to this privacy policy

AposHealth reserves the right, at its sole discretion, to modify this Privacy Policy at any time and without prior notice. If we modify this Privacy Policy, we will post the modified Privacy Policy and alert you to the modification on the Site or otherwise provide notice. We will also update the “Last Revision” at the top of this Privacy Policy.

By continuing to access or use the Site or the AposCare Services after we have posted a modified Privacy Policy or provided notice of a modification, you are indicating that you agree to be bound by the modified Privacy Policy. If the modified Privacy Policy is not acceptable to you, your only recourse is to cease using the Site and AposCare Services.

2. What information do we collect?

We collect two types of information (“Information”):

  • Personal Information is information associated with or that can be used to identify a specific individual, such as name, email address, postal address, zip code, or telephone number. Personal Information does not include information that has been aggregated or modified so that it can no longer identify a specific individual.
  • General Information is information about an individual’s online activity that, alone, cannot be used to identify that person, such as browser type, operating system, domain name, dates and times of Site access, website usage, traffic patterns, Site performance, and related statistics.

Personal Information and General Information may be linked together. Different types of General Information also may be linked together and, once linked, used to identify a unique individual.

3. How do we collect information?

A visitor can access and browse our Site without providing Personal Information that expressly identifies them. We do not collect information that would personally identify you unless you choose to provide it. To make full use of the AposCare Services, you may be required to provide Personal Information.

Personal Information that you provide to us

You may provide Personal Information when you contact us for help or information through a contact form or chat, sign up for newsletters, or otherwise voluntarily supply Personal Information to us. Personal Information provided through the contact form transfers into our CRM system. Both our CRM system and chat comply with HIPAA. We do not sell your Personal Information.

Information collected when you use the Site

When you use the Site, we collect Information about how you interact with the Site, including website usage, traffic patterns, Site performance, and related statistics. Some of the Information collected may be Personal Information. Third-party service providers that assist with business operations also collect Information on our behalf about Site usage.

We and our service providers use cookies, web beacons, and other Tracking Technology to collect Information, which may include IP address, domain name, browser type, mobile service provider, mobile device type, device identifier, operating system type, pages viewed, access date and time, referring website address, location, and websites visited before and after visiting the Site.

4. Tracking technology, do not track, and targeted advertising

We may collect Information automatically through cookies, web beacons, and other tracking technology (“Tracking Technology”). Tracking Technology collects Information about your use of the Site and may collect Information about your activities when you leave the Site and visit other Internet sites.

Cookies

A cookie is a small text file placed in your web browser directory to store information about your use of the Site. Cookies help improve your Site experience, for example by enabling the Site to recognize you when you return. To learn more, visit www.allaboutcookies.org.

Do Not Track

Some browsers include a “Do Not Track” feature. How browsers communicate the signal is not yet uniform, and many websites and applications, including the Site, are not set up to interpret Do Not Track signals.

Targeted advertising and opting out

Cookies and other Tracking Technology assist us in understanding who is interested in our products and services and making advertisements relevant. We use third-party vendors, including Google and DoubleClick, to display targeted advertising on websites across the Internet.

To opt out of receiving targeted advertising, visit the Network Advertising Initiative opt-out page or www.aboutads.info/choices and follow the instructions.

5. How do we process information?

How we use Information

We use Information that we collect about you or that you provide to operate, maintain, and enhance the Site, including to present the Site and its content, send information about AposHealth products and AposCare services, generate statistical information, develop advertising profiles using Tracking Technology, carry out contractual obligations, protect Site safety and security, contact you following your request, fulfill purposes for which you provide Information, and as otherwise described when you provide Information.

How we disclose Information

We may disclose Personal Information with your consent to relevant healthcare providers; to third-party service and technology providers that assist with business operations; to enforce agreements; to protect rights; to comply with applicable laws and regulations; to law enforcement or governmental agencies responding to lawful requests; and to an acquirer of all or substantially all of AposHealth’s assets.

6. Data retention

We retain Information for as long as needed to provide the Site and AposCare Services. We also retain and use Information as necessary to comply with legal obligations, resolve disputes, and enforce agreements.

7. Third-party websites

The Site may contain links to other websites. We do not and cannot control linked websites or any information submitted to or collected by those websites. This Privacy Policy applies solely to information collected by or through the Site.

8. Children under age 13

The Site is designed and intended for adults. In accordance with the Children’s Online Privacy Protection Act, we do not knowingly collect, store, or use Personal Information about children under the age of 13. Please contact us if you have reason to believe that a child under 13 has provided Personal Information.

9. For California residents

California law permits residents of California to opt out of AposHealth’s disclosure of Personal Information to third parties for direct marketing purposes. You may choose to opt out by submitting a written request to AposHealth, C/O Studio, 300 Park Ave, 2nd floor, New York, NY 10022 or by email.

California residents may also request, once per year and free of charge, a list of third parties to which AposHealth or AposCare disclosed Personal Information for direct marketing purposes in the prior calendar year, as well as the type of Personal Information disclosed. Requests must include the phrase “California Privacy Rights” and include your name and response address.

10. Patient privacy

In addition to this Privacy Policy, please see our Notice of Privacy Practices for detailed information regarding how information about your past, present, and future health care status may be used, accessed, and disclosed by AposCare.

11. Security

We follow generally accepted industry standards, including HIPAA, and use technical and organizational measures to protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of Personal Information. No Internet transmission or electronic storage method is 100% secure, so we cannot guarantee absolute security.

  • We limit access to Personal Information to employees, contractors, and agents who reasonably need that information.
  • We use physical, electronic, and procedural safeguards to reasonably protect Personal Information.
  • We train employees on confidentiality and privacy responsibilities.
  • Although we cannot guarantee against loss, misuse, unauthorized disclosure, alteration, or destruction of data, we try to prevent such occurrences.

12. Identity theft

Safeguarding Information to help protect you from identity theft is a top priority. We do not and will not request credit card information, login information, or national identification numbers in a non-secure or unsolicited email or telephone communication. 13. Security breach

The Site and AposCare Services rely on the Internet and mobile networks, which are not always secure. If we become aware of a security incident, we will notify you to the extent required under applicable law.

14. International transfer

Your Information may be transferred to and maintained on computers located outside of your state, province, country, or other governmental jurisdiction. If you are located outside the United States and choose to provide Information to us, AposHealth or AposCare transfers Personal Information to the United States and processes it there.

15. Right to non-discrimination

AposHealth and AposCare will not discriminate against you for exercising any privacy rights under law or as set forth in this Privacy Policy.
